Welcome to Texas Arms Exchange™ ("TAE," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at texasarmsexchange.com and all related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Platform, you confirm that you are at least 18 years old, a legal resident of the United States, and capable of forming a binding contract. If you do not agree to these Terms, do not use the Platform.

2. Platform Description

Texas Arms Exchange is a classified advertising platform that connects buyers and sellers of firearms, ammunition, knives, archery equipment, optics, and related outdoor gear. We do not buy, sell, transfer, ship, or take possession of any items listed on the Platform. All transactions are between individual users.

3. User Accounts

You must create an account to post listings or send messages. You agree to provide accurate information, maintain the security of your account, and notify us immediately of any unauthorized access. You are responsible for all activity under your account.

4. Listing Rules

All listings must comply with federal, state, and local laws. The following items are prohibited from listing:

  • Items prohibited under federal law (machine guns manufactured after 1986, destructive devices without proper NFA registration, etc.)
  • Items prohibited under Texas state law
  • Stolen property
  • Items with obliterated or altered serial numbers
  • Unregistered NFA items (suppressors, SBRs, SBSs, AOWs without proper tax stamps)
  • 3D-printed firearms without serial numbers where required by law
  • Explosives, destructive devices, or chemical/biological agents

5. User Conduct

You agree not to: use the Platform for any illegal purpose; misrepresent any item; sell to persons you know or reasonably should know are prohibited from possessing firearms; harass, threaten, or abuse other users; post spam or misleading content; attempt to circumvent Platform security; or create multiple accounts.

6. Legal Compliance

All users are solely responsible for complying with all applicable federal, state, and local laws regarding the purchase, sale, transfer, and possession of firearms and related items. Texas Arms Exchange does not provide legal advice and makes no representations regarding the legality of any specific transaction.

7. Fees

Basic listings on Texas Arms Exchange are free. We may offer optional premium features for a fee in the future. Any paid features will be clearly disclosed before purchase.

8. Intellectual Property

The Platform, including its design, branding, code, and content (excluding user-generated content), is owned by Texas Arms Exchange, LLC. You retain ownership of content you post but grant us a license to display it on the Platform.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXAS ARMS EXCHANGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION CONDUCTED THROUGH IT.

11. Indemnification

You agree to indemnify and hold harmless Texas Arms Exchange, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the state or federal courts located in Texas.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.
